Welcome to Speaker Doc, an iOS application that helps remove water from iPhone speakers using scientifically-tuned sound frequencies and haptic vibrations. These Terms of Use ("Terms") govern your use of the Speaker Doc mobile application ("App") and related services provided by Valentin Galmand ("we," "us," or "our").

By downloading, installing, or using Speaker Doc, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. App Description and Functionality

Speaker Doc is designed to help restore clear audio to iPhone speakers that have been affected by water exposure through:

• Sound Frequencies: Optimized low frequencies that vibrate water out of speaker grilles
• Haptic Vibrations: Uses iPhone's built-in vibration motor to enhance water displacement
• Speaker Testing: Tests left/right speakers before and after cleaning to measure improvement
• Progress Tracking: Real-time cleaning progress with visual feedback

Available Features:

• Free Turbo Clean: Basic water removal with limited frequency range
• Pro Deep Clean: Advanced cleaning with optimized frequencies (Premium)
• Haptic Booster: Additional vibrations during cleaning process (Premium)
• Before/After Testing: Speaker performance measurement
• Multi-Language Support: English and French

3. Eligibility and Age Requirements

You must be at least 4 years old to use this App. Users under 18 must have parental consent to make purchases or use the App. Parents and guardians are responsible for monitoring their children's use of the App.

4. Subscription Plans and Pricing

Speaker Doc offers the following subscription options through Apple's App Store:

Premium Plans:

• Lifetime Access: $59.99 (one-time purchase)
• Annual Subscription: $39.99/year
• Annual with 3-day Trial: $39.99/year (3-day free trial)
• Annual Promotional Offer: $19.99 first year, then $39.99/year
• Weekly Subscription: $6.99/week

Subscription Terms:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed and auto-renewal turned off in your Apple ID Account Settings
• Free trials convert to paid subscriptions unless cancelled before the trial period ends

5. Payment and Refunds

Payment Processing:

All payments are processed through Apple's App Store. We use RevenueCat for subscription management and Superwall for subscription offerings.

Refund Policy:

• All refund requests must be made through Apple's App Store refund process
• We do not directly process refunds; Apple handles all subscription billing and refunds according to their terms and conditions
• Refund eligibility is determined by Apple's refund policy

6. Privacy and Data Collection

Speaker Doc is designed with privacy in mind:

• No Account Required: The App does not require user registration or account creation
• No Personal Data Storage: We do not collect or store personal information on our servers
• Local Processing: All speaker testing and cleaning functions are processed locally on your device
• Subscription Management: RevenueCat handles subscription data in accordance with their privacy policy
• Analytics: We may use anonymous usage analytics to improve the App

Requirements:

• Active internet connection for initial download and subscription verification

USE AT YOUR OWN RISK. While Speaker Doc is designed to be safe for your device, we make no guarantees that using the App will not cause damage to your iPhone, speakers, or other components. You acknowledge that:

• Using sound frequencies and vibrations may affect your device in unforeseen ways
• We are not responsible for any damage to your device resulting from use of the App
• The App is not a substitute for professional repair services
• Severe water damage may require professional repair regardless of App usage

No Warranty:

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the effectiveness of water removal
• Any warranties regarding device safety or compatibility

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, or consequential damages
• Device damage, data loss, or repair costs
• Loss of use, revenue, or profits
• Any damages exceeding the amount you paid for the App subscription

Health and Safety:

• Use the App at reasonable volume levels to protect your hearing
• Stop use immediately if you experience any discomfort
• The App is not suitable for users with certain medical conditions affecting hearing or sensitivity to vibrations
• Consult a healthcare provider if you have concerns about using audio or haptic feedback

10. Intellectual Property Rights

Our Rights:

Speaker Doc, including all software, algorithms, user interface, and related materials, is owned by Valentin Galmand and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Your Rights:

You retain ownership of any content you create using the App (such as test results), but grant us permission to use anonymous, aggregated data for App improvement purposes.

Restrictions:

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Remove or alter any proprietary notices

11. Updates and Changes

App Updates:

We may release updates to improve functionality, fix bugs, or add features. Some updates may be required to continue using the App. Continued use of the App after updates constitutes acceptance of any changes.

Terms Updates:

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

Continued use after changes indicates acceptance of the modified Terms.

Speaker Doc is initially available in France and expanding internationally. Use of the App must comply with all applicable local laws and regulations in your jurisdiction.

Export Compliance:

The App may be subject to export control laws. You agree not to export or re-export the App to any country, person, or entity subject to applicable export restrictions.

13. Termination

By You:

You may stop using the App at any time by:

• Deleting the App from your device
• Cancelling your subscription through Apple's App Store
• Contacting Apple for subscription management

By Us:

We reserve the right to:

• Discontinue the App with reasonable notice
• Restrict access for violations of these Terms
• Modify or suspend features for maintenance or legal compliance

Effect of Termination:

• Your license to use the App will terminate immediately
• Active subscriptions will continue according to Apple's billing cycle
• These Terms will survive termination where applicable

14. Legal and Dispute Resolution

Governing Law:

These Terms are governed by French law. Any disputes will be subject to the jurisdiction of French courts.

Severability:

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement:

These Terms, along with Apple's App Store Terms of Service, constitute the entire agreement between you and us regarding the App.
